HPI Valuation terms and conditions

1. General

(a) In these terms and conditions (the "Conditions") the following expressions shall have the following meanings:-
"we"/ "us"/ "ours" means or refers to HPI Limited, who provides the Valuation to you;
"you"/ "your" means or refers to you, the customer, who submits the Enquiry and receives the Valuation (in each case subject to these Conditions);
"Enquiry" means an HPI Valuation enquiry submitted by you either online at the Website;
"Valuation" means the valuation supplied by us relating to a motor car recorded on our electronic database in response to your Enquiry;
"Contract" means the contract between you and us for the supply of the Valuation made subject to these Conditions;
"Website" means the hpicheck.com website on the world wide web.

(b) When you submit an Enquiry to us, this constitutes an offer by you to enter into a Contract with us for the provision of a Valuation subject to these Conditions. A Contract will only come into existence between you and us when we provide to you a Valuation in response to your Enquiry. We reserve the right for any reason and without explanation to decline to enter into a Contract with you.
(c) The Contract and any Valuation provided shall be subject to these Conditions which apply to the exclusion of all other terms, conditions and statements.
(d) When submitting your Enquiry at our Website, it is your responsibility to complete the request screens at our Website fully and correctly to ensure a prompt response by us.

2. Charges

You will pay us our charges for the Valuation at our current levels from time to time, by credit card or any other payment method we accept (details of which are available at the Website), before we supply you the Valuation.

3. Driveaway

Norwich Union Direct Driveaway cover is underwritten by Norwich Union Insurance Limited. Registered Office: 8 Surrey Street, Norwich NR1 3NG. Registered in England No. 99122.

Authorised and regulated by the Financial Services Authority. For purpose of the Data Protection Act 1998, the data controller in relation to any personal data you supply is Norwich Union Insurance Limited. For our joint protection calls may be recorded and/or monitored. Cover not available in N. Ireland. Quotation valid for 60 days. Age restrictions apply.

Norwich Union Direct may decline to quote in some circumstances

4. Warranty / Liability

(a) The Valuation is provided on an "as is" basis for use at your own risk. No warranties of any kind, express or implied are given in the Website, including but not limited to those of title, satisfactory quality, fitness for a particular purpose or non-infringement of intellectual property rights.

(b) The Valuation derives from original data provided by car manufacturers and other suppliers. Those manufacturers and suppliers have full control over the data they supply to us and we cannot be held responsible for any such data which is erroneous, out-of-date or incomplete.

(c) In utilising this service, you acknowledge and agree that any valuation is indicative only of the price of any car and that it is provided on the basis that:
(i) the car is roadworthy, undamaged and has only been subject to normal wear and tear;
(ii) the next major service is not due within the next 12 months; and
(iii) the tyres of the car are not more than 50% worn.

(d) Prices will also vary between dealers who may provide purchasers with different services such as warranty protection and preparation of the car and similarly prices may vary as a result of specific regional or market fluctuations.

(e) The Valuation we supply to you is indicative only and is based on data supplied to us from a number of sources, including third parties over whom we have no control. You agree, therefore, that we do not warrant that the Valuation is true, correct or complete and that we shall not:-
(i) be liable in any circumstances for any loss or damage arising from any inaccuracies, faults or omissions in the Valuation, unless caused by our negligence or wilful default; and
(ii) in any circumstances (including, without limitation, if we have been negligent) be liable for any direct, indirect or consequential loss or damage at all, or for any loss of business, capital, profit, reputation or goodwill whether caused by us, our servants or agents arising out of or in connection with the Contract or its subject matter.

(f) We do not limit or exclude our liability for death or personal injury arising from our negligence or that of our servants or agents.

(g) Our entire liability (except for death or personal injury arising from our negligence or that of our servants or agents) in respect of all claims arising out of or in connection with the Contract shall not exceed the amount paid by You for the Valuation.

(h) We shall not be liable for the accuracy of, or any loss or damage arising from, any Valuation we supply to you as a result of any incomplete or inaccurate data or information you supply to us or as a result of any other fault attributable to you.

(i) Except as expressly provided in the Contract, all other conditions, terms and warranties, express or implied by statute or otherwise are excluded to the fullest extent permitted by law.

(j) Each provision of this Condition 4 is to be construed as a separate limitation applying and surviving even if for any reason one or the other of the said provisions is held inapplicable or unreasonable in any circumstances, and shall remain in force notwithstanding the performance of the Contract.

5. No right to Cancel

You agree that you have no right to cancel the Contract under the Consumer Protection (Distance Selling) Regulations 2000 after we have received and commenced processing your Enquiry.

6. Use of your Personal Data

We obtain and hold car and associated data from many sources, including finance companies, insurers, car owners and the police. This data is used to protect both those making searches and the owners of cars on our registers. For that reason, you agree and consent to us disclosing relevant information about you (including your name, address and details of your usage of our services) to any person to whom we consider that it would be expedient to do so, for the sole purposes of preventing, detecting or discouraging crime, for the apprehension or prosecution of offenders, or for the recovery of stolen cars or other property. Without limiting the foregoing, you expressly agree and consent to us disclosing any such information about you to:-
(a) a person claiming to be owner of a car against which you have submitted an Enquiry; or (b) the police or other law enforcement authorities.

7. Your use of the Valuation

The Valuation we provide to you is for your own personal use. Accordingly you must not sell, supply or otherwise disclose the Valuation to any third party, but you may supply free of charge a printed copy of the Valuation to any potential purchaser or the seller of a car to which the Valuation relates (in the course of negotiating the purchase or sale of the car) provided that the Valuation is in the form supplied by us (without amendment to any of the contents).

8. Miscellaneous

(a) You may not transfer, assign or in any way make over to any third party the benefit of the Contract or any part of it.
(b) Neither you nor we shall be liable to the other for any delay in or failure to perform any of our respective obligations under the Contract due to any cause beyond your or our reasonable control.
(c) You agree that you are under no duty or obligation to obtain the Valuation and you accept that electronic receipt of the Valuation shall constitute actual notice of the Valuation, for the purposes of paragraph 22 of Schedule 4 of the Consumer Credit Act 1974.
(d) If any provision of the Contract is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of the Contract and the remainder of the provision in question shall not be affected.
(e) This Contract shall be governed by and construed in accordance with English law, and you agree to submit to the exclusive jurisdiction of the English Courts.

Valuation Definitions

Dealer : The sale price for a car in good condition for its age and mileage, being retailed by a car dealership. Actual retail sale price for a car will vary depending on any additional options and or modifications made to the car by the current and or previous owners.

Private : The sale price for a car in good condition for its age and mileage, being sold by a private seller.

Part /Exchange : The value of a car in good condition for its age and mileage, when traded in against another car at a motor retail outlet.

Trade : The value of a car in good condition for its age and mileage, if sold direct to a motor dealer with no part exchange.


WHY IS THERE A DIFFERENCE BETWEEN THE TRADE IN AND RETAIL PRICES?
The trade in price (the amount a dealer pays you) differs from the retail price (the price a dealer advertises the car) because a dealer has the following costs and considerations:

  • Refurbishment, valeting, servicing & stocking/storage
  • Warranty, administration & title checks
  • Profit, advertising & VAT

Value validity & explanation

We may not be able to provide a Valuation if a car is:

  • outside the age range 6 months to 9 years old
  • outside the mileage range 10,000 - 150,000 miles
  • a specialist or limited edition car
  • in short supply or a rare car

Mileage adjustments are rounded to the nearest thousand miles.

Standard and optional equipment is displayed in alphabetical groupings. Where an item was standard fit it will be automatically ticked; where items were optional the price shown is the manufacturer's original list price (not the value it adds to the current valuation).

All valuations given are based on a single transaction with a bona fide motor dealer involving the sale of the consumer's car in part exchange for the purchase of a different car from the

    same dealer
. Values are not cash values, replacement prices, private sales values or insurance settlements and therefore must not be used for any other valuation purposes whatsoever.

Car prices are affected by many different factors such as regional variations, sales promotions, as well as a dealer's perceived view of the condition of a car. The amount quoted should not be relied upon solely, and should be treated as a guide only.

Security and Privacy Policy

We take all the necessary steps to ensure the security of your transaction with us and to protect the privacy of the information you give to us.

Your Online Security
We recognise the importance of secure online transactions, and we safeguard the privacy of information provided to us through online forms.

We use a Digital Certificate to assure you of the validity of our site and for consumer requests submitted to us online, we use Secure Sockets Layer technology to provide strong encryption for the data you provide on the order form before transmission to us. Card payments are processed by Barclays Merchant Services.

Privacy - how we use information about you
We are registered under the Data Protection Act (1998) which contains important provisions governing the use of data about private individuals.

We do not ask for any information about you in order to let you use our site. Such use is subject to our HPI Web Site Terms & Conditions.

Valuation on the fact of your enquiry with us, or on the car data provided to you in return, remains confidential and will only be provided to third parties for marketing purposes where you have given us your explicit consent at the time of purchase. Where consent has been given, it is our policy only to deal with third parties who can offer special benefits to our customers.

We are committed to fighting car crime and works closely with law enforcement agencies, especially the police, to investigate car theft and fraud. We value the information that such agencies provide, which helps all our customers avoid the risks presented by stolen cars.

In return, when you buy our services, you agree that we may provide data about you and your enquiry to the police or other law enforcement agencies, where doing so will assist them in their enquiries. You should also be aware that under section 28 of the Data Protection Act (1998), the police and other agencies can require us to disclose this information, again without your consent.
