Terms and Conditions relating to a Consumer CRiS Check
1. General
- 1.1 These terms and conditions (the "Terms") set out the basis upon which HPI Limited ("we", "us" or "our") are prepared to provide and/or confirm to you (the "Service") the information ("Information") relating to a particular caravan as recorded on our electronic database in response to an enquiry made by you by telephone to our call centre ("Enquiry"). By making any Enquiry you are bound by and agree to be legally bound by these Terms as modified from time to time. No other terms or conditions will form any part of the contract concluded between you and us.
- 1.2 When you submit an Enquiry to us we will confirm whether the information that you provide in relation to a particular caravan corresponds with the Information that we hold on our database. We may also provide you with additional Information that we hold concerning such caravan. We will not, however, provide you with any details of the registered keeper or former keepers of the caravan, other than to confirm or deny the current keeper of the caravan and to confirm the information contained within your Enquiry, nor disclose any other personal data.
- 1.3 When submitting your Enquiry over the telephone you must provide our operator with accurate and complete information to ensure we are able to deal with your Enquiry promptly, including the Vehicle Identification Number.
2. Charges
- You will pay us our charges for the Service at our current levels as varied from time to time, by credit card or any other payment method we accept (details of which are available from our call centre operator), before we provide such Service.
3. Limitation of Liability
- 3.1 The Service that we provide to you relies upon data supplied to us from a number of sources, including third parties over whom we have no control. You agree, therefore, that although we use reasonable skill and care in providing the Service, we do not warrant that the Information is true, correct or complete and that (subject to paragraph 3.2 below) we shall not:
- 3.1.1 be liable in any circumstances for any loss or damage arising from any inaccuracies, faults or omissions in the Information, unless caused by our negligence or wilful default; and
- 3.1.2 in any circumstances (including, without limitation, if we have been negligent) be liable for any direct, indirect or consequential loss or damage at all, or for any loss of business, capital, profit, reputation or goodwill whether caused by us, our servants or agents arising out of or in connection with the provision of the Service or confirmation of Information.
- 3.2 We do not limit or exclude our liability for death or personal injury arising from our negligence or that of our servants or agents.
- 3.3 We shall not be liable for the accuracy of, or any loss or damage arising from, the Service we supply to you as a result of any incomplete or inaccurate data or information you supply to us or as a result of any other fault attributable to you.
- 3.4 Except as expressly provided in these Terms, all other conditions, terms and warranties, express or implied by statute or otherwise are excluded to the fullest extent permitted by law in particular, but without limitation, any warranty that:
- 3.4.1 the information that we hold relating to the registered keeper of a caravan is correct or up to date or that the registered keeper of a caravan is the legal owner or is entitled to sell or transfer ownership of a caravan;
- 3.4.2 a caravan registered on CRiS complies in any respect with any applicable laws, regulations, directives and standards relating to such vehicle.
- 3.5 Nothing contained in these Terms is intended to affect nor will it affect any of your statutory rights if you are a consumer (within the meaning contained in the Unfair Contract Terms Act 1977).
4. Your use if the Information
- The Service that we provide to you and any Information provided as a part of such Service is for your own personal use. Accordingly you must not sell, supply or otherwise disclose the Information or otherwise pass the benefit of the Service to any third party, but you may supply details of the result of any Enquiry that you make to any potential purchaser or the seller of the caravan to which the Enquiry relates (in the course of negotiating the purchase or sale of the vehicle) provided that the Information is in the form supplied by us (without amendment to any of the contents).
5. Miscellaneous
- 5.1 You may not transfer, assign or in any way make over to any third party the benefit of these Terms.
- 5.2 Neither you nor we shall be liable to the other for any delay in or failure to perform any of our respective obligations under or in accordance with these Terms due to any cause beyond your or our reasonable control.
- 5.3 If any provision or part of any provision of these Terms is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions or remaining part of such provision shall not be affected.
- 5.4 These Terms shall be governed by and construed in accordance with English law and you agree to submit to the exclusive jurisdiction of the English Courts.
- 5.5 We obtain and hold keeper, caravan and associated data which is used to protect both those making searches of and the keepers of caravans on the CRiS register. We obtain, hold and process such data in accordance with the requirements of the Data Protection Act 1998 and any other applicable data protection legislation. If you make an Enquiry in relation to a caravan which is recorded on our database as stolen then if you expressly agree we may pass your details on to the police. We may also disclose, and you expressly consent to us so disclosing, relevant personal data about you provided to us during your Enquiry (including your name and address) and any other information contained within the Enquiry to the police or to any person if required to do so in order to comply with the law, legal process or any order of a court of competent jurisdiction.
